Auto Insurance in South Carolina
South Carolina requires all drivers to carry minimum liability limits of 25/50/25 under SC Code 38-77-140: $25,000 bodily injury per person, $50,000 bodily injury per accident, and $25,000 property damage per accident. SC also requires uninsured motorist coverage (UM) at the same 25/50/25 minimums with a $200 property damage deductible under SC Code 38-77-150. These are legal minimums. South Carolina is an at-fault (tort) state. The driver who causes the accident is financially responsible for the other party’s damages. SC follows a modified comparative negligence rule under SC Code 15-38-15. You can recover damages if you are 50% or less at fault, but your recovery is reduced by your percentage of fault. If you are 51% or more at fault, you recover nothing from the other driver. This is why carrying liability limits above the SC minimum is important. “Full coverage” is not an official insurance term. Liability insurance covers damage you cause to other people and their property. What people call “full coverage” typically means liability plus collision (covers your vehicle in an accident) plus comprehensive (covers theft, vandalism, hail, flooding, and animal strikes). Uninsured motorist (UM) coverage pays for your injuries and damages if you are hit by a driver with no insurance. South Carolina is one of the states that requires UM coverage. Under SC Code 38-77-150, you must carry UM at the same limits as your liability (minimum 25/50/25) with a $200 property damage deductible. You can also buy underinsured motorist (UIM) coverage, which is not required but must be offered by your carrier under SC Code 38-77-160. An SR-22 is a certificate of financial responsibility that your insurance company files electronically with the SC DMV. It is not a type of insurance. You need an SR-22 after a DUI conviction, driving without insurance, or accumulating too many points on your license. South Carolina typically requires you to maintain an SR-22 for 3 years. Under SC Code 56-10, driving without insurance in South Carolina carries increasing penalties. First offense: $100 to $200 fine or up to 30 days in jail. Second offense: $200 fine and/or 30 days jail. Third and subsequent offenses: 45 days to 6 months in jail. Your license and registration are suspended, and you pay a $200 reinstatement fee. You may also owe an uninsured motorist fee of approximately $550. Convictions are tracked within a 5-year lookback period. Many drivers also need an SR-22 filing before they can reinstate their license and get back on the road.
SC law waives the deductible for glass claims if you carry comprehensive coverage on your auto policy. This means your windshield can be repaired or replaced with no out-of-pocket cost beyond your regular premium. However, this only applies if comprehensive is part of your policy. Without comprehensive coverage, glass damage is entirely out of pocket. First, check for injuries and call 911 if anyone is hurt. Move to a safe location if possible. Exchange names, phone numbers, insurance information, and vehicle details with the other driver. Get contact information from any witnesses. Request a police report. Take photos of all vehicles, damage, road conditions, and the scene. Do not admit fault. Homeowners Insurance
No. South Carolina does not require homeowners insurance by state law. However, if you have a mortgage, your lender requires it as a condition of the loan. If you let your homeowners policy lapse, the lender can purchase force-placed insurance on your behalf, which costs significantly more and provides less coverage. A standard homeowners policy (HO-3) covers your dwelling against fire, wind, hail, lightning, vandalism, and other named perils. It also covers other structures on your property like detached garages and fences, personal property inside and outside your home, loss of use if your home becomes uninhabitable, personal liability if someone is injured on your property, and medical payments to others. Standard homeowners insurance does not cover flood damage, earthquake, sewer or drain backup (requires a separate endorsement), high-value items above policy sublimits (jewelry, firearms, art), business property or liability, intentional damage, normal wear and tear, or pest and termite damage. Generally, your homeowners insurance covers damage to your property from a fallen tree, regardless of where the tree was rooted. An HO-4 renters policy also includes personal liability coverage and additional living expenses if your apartment becomes uninhabitable. Greenville has significant flood exposure along the Reedy River corridor through downtown, the Saluda River in northern Greenville County, and the Enoree River to the south.
