South Carolina Motorcycle Laws Every Rider Should Know

Helmet Law: Under 21 Only
South Carolina requires helmets for riders and passengers under 21. Riders 21 and older can legally ride without one, but keep in mind that 64% of motorcycle fatalities in SC involve unhelmeted riders. Helmets must be SCDPS-approved with a chin strap and reflectorized on both sides. Source: SC DPS.
Eye Protection
Riders under 21 must wear goggles or a face shield at all times while operating a motorcycle. For riders 21 and older, eye protection is not legally required but strongly recommended, especially on highways like I-85 and SC-11.
Passenger Rules
Passengers must have a permanent, regular seat and footrests, and passengers under 21 must wear a helmet. If you frequently ride with a passenger, make sure your policy includes guest passenger legal liability coverage.
Lane Splitting: Illegal in SC
Unlike California, lane splitting (riding between lanes of traffic) is illegal in South Carolina under SC Code 56-5-3640. Motorcycles must occupy a full lane, and you cannot weave between cars, even in stopped traffic.
Headlight-On Law
South Carolina requires motorcycles to have their headlight on at all times while operating, day and night. Most modern bikes do this automatically, but check yours.
Class M License & Registration
You need a motorcycle license to operate a motorcycle on public roads in South Carolina. An MSF (Motorcycle Safety Foundation) course may help with licensing and can qualify you for insurance discounts. You must show proof of motorcycle insurance before registering your bike with the SC DMV. Riding without insurance can result in fines, license suspension, and a mandatory SR-22 filing for three years.
Hands-Free Law (New)
